Terms and Conditions - Agent
Welcome to Sorha Aana Developers Pvt. Ltd. These terms and conditions outline the rules and regulations for the engagement of agents who work with us in real estate services, including but not limited to property leasing, renting, and related tasks. By accessing and using our services, you agree to the following terms and conditions. Please read them carefully.
1. Parties Involved
1.1. Company: Sorha Aana Developers Pvt. Ltd., a real estate company involved in property development, leasing, and management.
1.2. Agent: Any individual or entity that has entered into an agreement with the company to assist in property leasing, renting, and other related tasks.
2. Agent Responsibilities
- The Agent agrees to act as a representative in all matters related to the property, including but not limited to leasing, renting, and coordinating construction activities on behalf of Sorha Aana Developers Pvt. Ltd.
- The Agent shall ensure that all tasks are performed in accordance with legal requirements, environmental standards.
- The Agent agrees not to undertake any activities beyond the scope of this agreement without prior written consent from the Company.
- The Agent will not engage in any personal use of the property or its resources without prior permission from the Company.
3. Company Responsibilities
- The Company agrees to provide necessary support and compensation to the Agent for the services rendered based on the completion and quality of the tasks assigned.
- Compensation terms will be decided mutually, and the Company shall be responsible for payments after a proper review of the completed tasks.
- The Company will oversee that all activities conducted by the Agent are in compliance with local laws and regulatory standards.
4. Compliance and Legal Matters
- The Agent is responsible for ensuring that all activities related to the property are carried out in compliance with the applicable legal framework, including laws pertaining to property use, environmental protection.
- In the event of any legal issues arising from the Agent's work, the Agent will cooperate fully with the Company to resolve the issue promptly.
- Any breach of local regulations by the Agent that results in fines or penalties will be the responsibility of the Agent.
5. Limitations and Restrictions
- The Agent shall not lease or rent the property to any third party without prior written approval from the Company.
- Unauthorized usage of the property's natural resources will be considered a breach of contract, and appropriate legal action may be taken.
6. Termination of Agreement
- Either party may terminate this agreement by providing a written notice of at least 30 days, citing reasons for termination.
- The Company reserves the right to terminate the agreement immediately if the Agent is found to be involved in fraudulent or illegal activities.
- Upon termination, the Agent shall return all Company-owned materials and properties that may have been in their possession.
7. Indemnification (Compensation Terms)
The Agent agrees to indemnify and hold harmless Sorha Aana Developers Pvt. Ltd., its directors, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from the Agent's actions or omissions in connection with their duties under this agreement.
8. Modifications to Terms
Sorha Aana Developers Pvt. Ltd. reserves the right to modify these terms and conditions at any time. Any changes will be posted on the website, and it is the responsibility of the Agent to review these terms regularly. Continued use of the services will be deemed acceptance of the updated terms.
9. Governing Law
These terms and conditions are governed by the laws of Federal Democratic Republic of Nepal, and any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts in Gandaki Province, Nepal.
